Costs and Service Information for Debt Recovery work
How we charge:
Please note this information is only regarding the work we carry out for our clients in relation to Debt Recovery work.
It is important that you can budget for our services and in order to facilitate that we will charge prescribed hourly rates to carry out Debt Recovery work on your behalf.
Our current hourly rates are £260.00 plus 20% VAT per hour for Partners plus any disbursements (disbursements are expenses which include Court fees and Counsel’s fees). We may increase our hourly rates from time to time and if this happens, we will notify you in writing in advance.
If possible, we will charge a fixed fee for certain items of work (such as drafting letters) which will be calculated based on the volume and complexity of the agreed work. The fixed fee will include obtaining your instructions, carrying out the work and delivering the work to you. Our fixed fees do not include undertaking additional work where something unforeseen has occurred, where your instructions or circumstances have changed, or where you do not provide us with timely instructions.
Factors that can affect the complexity of a matter:
Fee estimates can change depending on the complexity of a matter and there are lots of factors that affect our original fee estimates. If fee estimates are going to change, we will consult you in advance. The factors can include (but are not limited to) the following:
• Whether your matter can be resolved by us writing a single or small number of letters to the debtor demanding payment. If it can, this would most likely constitute a simpler matter for the purposes of this pricing information.
• Whether the debt is disputed and requires a number of communications from us, consultations with you and negotiations to resolve the matter, but the matter is resolved without the need for court proceedings, then this would most likely constitute medium complexity for the purposes of this pricing information.
• Whether the debt is disputed and the debtor refuses to pay, meaning that we have to issue court proceedings on your behalf in order to resolve the matter. We may also have to get involved in enforcing the Judgement debt. If this action is needed, then the matter would most likely constitute high complexity for the purposes of this pricing information.
• The commercial reality that sometimes the cost of litigation outweighs the compensation sought. We would advise you along the way as to whether the matter should progress or possibly be settled earlier than originally planned.
Whilst some firms are willing to conduct litigation on a no-win, no-fee basis or a damages-based agreement, our firm does not offer these services as a means of payment. In the alternative, you may be covered by legal expenses to cover the costs that you may be liable to pay us or others involved in your matter. We recommend you check with your insurance broker at the outset of any work.
